The Decent Homes Standard has applied to social housing since 2000, but private tenants have never had equivalent statutory protection. The Renters' Rights Act changes this by extending the standard to the private rented sector, though the detailed regulations are still to be set through secondary legislation.
Under the standard, a property must be free from serious hazards (as assessed under the Housing Health and Safety Rating System), be in a reasonable state of repair, have reasonably modern facilities (kitchen, bathroom, and heating), and provide adequate thermal comfort.
When the private sector version takes effect, landlords who fail to meet the standard will face enforcement by local councils, with powers to issue civil penalties of up to Β£7,000. Tenants will also be able to pursue remedies through the courts and the new Landlord Ombudsman.
