What is landlord licensing?

Landlord licensing is a system operated by councils that requires landlords to obtain a licence before they can legally let certain types of property. Mandatory licensing applies to larger HMOs, while additional and selective licensing schemes are introduced by individual councils to cover others.

If your property requires a licence and your landlord doesn't have one, they're committing a criminal offence. More importantly for you, it means you may be able to apply for a rent repayment order through the First-tier Tribunal, recovering up to 12 months' rent.

Mandatory HMO licensing applies across all of England for properties occupied by five or more people from two or more households in a building of three or more storeys. Many councils also run additional licensing (covering smaller HMOs) and selective licensing (covering all private rented properties in a designated area, regardless of whether they're shared).

You can check whether your property requires a licence by contacting your local council's private sector housing team or searching their online register. If your landlord is operating without a required licence, report it to the council.

How do I check if my property needs a licence?

Contact your local council's private sector housing team or search their website for their licensing scheme details and public register. The requirements vary by area because additional and selective schemes are set by individual councils.

What happens if my landlord doesn't have a required licence?

The landlord is committing a criminal offence and can be fined or prosecuted. You can apply to the First-tier Tribunal for a rent repayment order of up to 12 months' rent. The landlord also can't serve a valid Section 8 notice on certain grounds while unlicensed.

Does every rented property need a licence?

No, mandatory licensing only applies to larger HMOs. Additional and selective licensing depends on your local council's schemes. Many standard single-let properties don't require a licence unless they're in an area covered by selective licensing.
