What is subletting?

Subletting is when you rent out all or part of the property you're renting to someone else, becoming their landlord while remaining a tenant of the original landlord. Most tenancy agreements in the UK prohibit subletting without the landlord's written consent.

If your tenancy agreement prohibits subletting (which most do) and you sublet without your landlord's permission, you're in breach of your tenancy terms. Your landlord could use this as a discretionary ground for possession under Section 8, and it could also affect your security deposit if the subtenant causes damage.

Subletting the whole property is treated more seriously than subletting a room. If you sublet the entire property, you're no longer living there as your main home, which means your assured tenancy may lose its statutory protections.

If you want to sublet, the correct approach is to ask your landlord in writing for consent. If your tenancy agreement says subletting is allowed with consent, the landlord can't unreasonably refuse. If it's completely prohibited, the landlord can refuse outright.

Frequently asked questions

Can I Airbnb my rental property?

Almost certainly not without your landlord's written consent. Short-term letting through platforms like Airbnb is a form of subletting and is prohibited under most tenancy agreements. Doing so without permission could lead to possession proceedings.
+

Is having my partner move in considered subletting?

No, as long as your partner isn't paying you rent separately for exclusive use of part of the property. However, you should inform your landlord, as most tenancy agreements require you to notify them of any additional occupants.

What happens to my subtenant if I'm evicted?

If your tenancy ends, your subtenant's right to occupy the property typically ends as well. They have no direct tenancy with your landlord. This is one of the risks of being a subtenant.
